1. The Defendant’s disposition of demotion against the Plaintiff on November 8, 2016 is revoked.
2. The costs of the lawsuit are assessed against the defendant.
Reasons
1. Details of the disposition;
A. The Plaintiff is a local public official who was appointed to the Gyeonggi-do Office of Education on September 8, 1992 and served in the Gyeonggi-do District Office of Education at the same time, serving as the B Team Team leader (official) at the Gyeonggi-do Office of Education from September 1, 2010 to January 1, 2012, and is in charge of the practice of the “C Project” (hereinafter “instant project”);
B. On February 201, the Plaintiff received instructions from D in charge of administrative management from D to develop a system to promote communication among persons related to the field of education (school teachers, school personnel, students, parents, etc.). On April 2011, the Plaintiff drafted “2011 C Implementation Plan (Evidence A7)” (Evidence A) around May 20, 201, “C detailed Promotion Plan (Evidence 11)” (Evidence A), “C detailed Promotion Plan (No. 12)” (Evidence A), and “C detailed Promotion Plan (No. 12),” around June 201, 201,” respectively.
C. On July 15, 2011, the Gyeonggi-do Office of Education held an explanatory meeting on the instant project against mobile communications business operators (Stecom, K, Lblass), and on July 25, 201, selected Lblass, among mobile communications business operators, as the priority negotiations for the instant project.
On December 29, 2011, the Gyeonggi-do Office of Education drafted the "Agreement on the Use of Services" and the "Agreement on the Use of Services" (hereinafter referred to as the "Agreement", and the "Agreement" shall be referred to as the "Agreement"), and the main contents are as follows:
