Punishment of the crime

However, there was no intention or ability to send goods from the beginning, since the above computer was already sold to the buyer and the buyer was paid the price.

The Defendant received KRW 505,00 from the victim’s bank account in the name of the Defendant on the same day, and received total of KRW 2,190,000 from around that day to December 14, 2015, including the transfer of KRW 505,00 from the victim’s bank account (C) and from around that day to December 14, 2015.

Accordingly, the defendant was informed of the victims to receive property.

On August 1, 2015, the Defendant posted a letter to the effect that “as soon as 2.50,000 won is first deposited, the account will be transferred” on the Internet game item’s bulletin board, “as soon as 120,000 won is sold,” at the Defendant’s house located in Seopopo City D, Seopopo City, 2015, the Defendant reported the letter to the effect that “as soon as 2.50,000 won is first deposited, it shall be transferred to the account.”

However, the facts are that the defendant thought that he only received money from the victim to use it as living expenses, etc., and he did not have the intent or ability to transfer the above game account to the victim.

As such, the Defendant, by deceiving the victim, received 250,00 won from the victim to the NongHyup Bank account under the name of the Defendant on the same day.

On February 8, 2016, the Defendant posted a letter to the effect that “to sell cultural merchandise coupons” on the bulletin board of “Search item car page,” and reported it to the victim F, who visited the victim F, “27,000 won.”
