A defendant shall be punished by imprisonment for six months.
However, the execution of the above sentence shall be suspended for a period of two years from the date this judgment became final and conclusive.
Reasons
Punishment of the crime
1. A person who violates the National Sports Promotion Act shall not engage in gambling which makes property or profits from sports promotion, taking advantage of the voting rights for sports promotion or any similar things issued by a person who is not an entrusted business entity and the Korea Sports Promotion Foundation for the Seoul Olympic Games or by using those issued by a person who is not an entrusted business entity;
Nevertheless, the Defendant, from September 20, 2016 to December 24, 2016, visited the private sports territory gambling site (G, H, I, and J) at the hold room where the Defendant had been living in the Republic of Korea near Suwon-si F, and then used the said operator as the Dom Bank’s deposit account (C504354913), etc. to the Dom Bank account (C504359913), etc., the Defendant deposited KRW 50,70,000 over 61 times in total as shown in the attached crime list. If the result was predicted, the Defendant was able to receive the amount of betting, receive the amount of betting, and obtained the amount of betting if he had lost the amount of betting.
2. No person, other than an entrusted business entity of the Seoul Olympic Sports Promotion Foundation that violates the National Sports Promotion Act by publicizing similar acts, shall publicize sports promotion voting rights or other similar things and provide property or property benefits (hereinafter referred to as "similar acts") to persons who correctly predicted the result thereof, or mediate or arrange the purchase thereof;
