1. The defendant shall be punished by imprisonment with prison labor for ten months;
2.Provided, That the above sentence shall be executed for three years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
1. Around 04:00 on January 24, 2013, the Defendant: (a) stolen the Victim D (Nam, 29 years of age) by taking advantage of the gap in the supervision of the Victim D within the C week located in Busan Sho-gu, Busan; (b) thereby bringing about KRW 60,000 in cash owned by the Victim and KRW 60,000,000 and KRW 1,000,000 in black cards, etc.
2. On January 24, 2013, the Defendant purchased 2 fluor tobacco equivalent to KRW 50,000 from the F convenience store located in Busan Seo-gu, Busan, on two occasions, and settled the payment by using the D’s crush card as above.
3. On January 24, 2013, the Defendant purchased 25,000 won or more from the H convenience store located in Busan Seo-gu G, Busan, and settled the payment by using the clock card of community credit cooperatives owned by D as above.
4. On January 24, 2013, around 04:30, the Defendant purchased 50,000 fluor tobacco at the J convenience store located in Busan Seo-gu, Busan, and settled the payment by using the fluor card of a community credit cooperative owned by D as above.
5. On January 24, 2013, around 04:33, the Defendant purchased heart tobacco equivalent to KRW 50,000 from the L convenience store located in the Busan Seo-gu, Busan, and settled the purchase of 20,000,000 won and 20,400,000, by using the CFC card of a stolen community credit bank.
6. On January 24, 2013, around 04:43, the Defendant: (a) settled the taxi fee of KRW 30,00 by taking a taxi on the street in front of the L convenience store located in the Busan Seo-gu K, Busan, and paying the taxi fee of KRW 30,00,00; and (b) made payment by using the Da’s ck card by using the aforementioned c
