Basic Facts

The defendant is a non-corporate association established around January 20, 201 for the purpose of creating profits through the harvest sale of environment-friendly agricultural products (such as company, rice, etc.), promoting mutual friendship, contributing to joint work, joint sale, production of high quality agricultural products, and increase of income.

Plaintiff

B around February 8, 2012, and around May 9, 2012, Plaintiff A is a person who has joined as a member of each Defendant.

In accordance with Article 19 of the former Environment-Friendly Agriculture and Fisheries Act, the Gyeongbuk-do government has selected a business entity who wishes to create an environment-friendly agricultural district and has subsidized a certain amount of the project expenses as national and local expenses.

On December 31, 2010, the Gyeongbuk-do notified the head of Si/Gun by January 31, 2011, that the person who wishes to develop an environment-friendly agricultural district in the 2012 Si/Gun, including the Gyeongbuk-do, shall prepare a project plan, etc., and shall submit the project plan and a written review opinion thereon to the head of Si/Gun by February 28, 201.

On or around January 201, the defendant submitted a business plan including construction of low temperature warehouses and construction of fine-free storages to sell eco-friendly agricultural products, which includes 16 members of the defendant's organization, and among them, the number of farmers certified low agricultural products and agricultural products without agricultural chemicals is 10.15 hectares in total. The defendant filed an application for the environment-friendly agricultural district development project in 2012.

On February 24, 2011, literature-si submitted a written review of the application for the development project of the environment-friendly agricultural district and the project plan submitted by the defendant to the Gyeong-si.

On November 10, 201, 201, Gyeongbuk-do selects the district requested by the Defendant as a district subject to the creation project for the Green Growth Promotion Zone with the subsidies of the Do and Si/Gun expenses and the project cost recognized as KRW 660 million (the amount reduced from KRW 79 billion to KRW 49 million).
