1. The plaintiff's claims against the defendants are all dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. Basic facts
A. In the case where all of the above real estate is referred to as “each of the above real estate,” the former 605m2, H, 453m2, 113m2, and J 145m2 (hereinafter referred to as “each of the above real estate”). N died on August 19, 1943, and N inherited N’s property on the part of the head of Australia, a family heir, and the Plaintiff succeeded to N’s property on September 26, 1950.
B. Meanwhile, under the Act on Special Measures for the Registration, etc. of Ownership of Real Estate (Act No. 3094), Defendant B completed the registration of ownership transfer on April 5, 1973 with the former District Court 9908 receipt on March 24, 1980, No. 9908 of the former District Court 605m2 and H large 453m2, pursuant to the Act on Special Measures for the Registration, etc. of Ownership of Real Estate (Act No. 3094). Defendant B completed the registration of ownership transfer on the ground of sale on April 25, 1979 with the same registry office 10120m2 under the Act on Special Measures for the Registration, etc. of Ownership of Real Estate, and completed the registration of ownership transfer on the ground of sale on April 12, 1979 (hereinafter collectively referred to as “Special Measures Act”) under the Act on Special Measures for the Registration, etc. of Ownership of Real Estate (hereinafter referred to as “Special Measures Act”).
C. After that, P, based on Defendant B’s above transfer of ownership, completed the registration of ownership transfer as stated in the claim(s) as to H 453m2, I 113m2 and J 145m2. Defendant D again completed the registration of ownership transfer as stated in the claim(s) as to H 453m2 and J 145m2, and Defendant D again completed the registration of ownership transfer as to H 45m2 and J 145m2. Defendant E subsequently completed the registration of ownership transfer as stated in the claim(s) as to H 453m2 and J 145m2.
On the other hand, after the P died on October 7, 2005, the Defendant F and F, who was the wife, succeeded to the P's property.
