1. The plaintiff's claim is dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. Basic facts
A. On February 16, 1926, the network D completed the registration of initial ownership at the Suwon District Court No. 1960, which received on February 16, 1926, with respect to the land of 946 square meters (hereinafter “the land before the subdivision of this case”).
B. The land prior to the instant partition was 3,127 square meters prior to E following the conversion of the area into the area on July 11, 1981.
C. F completed the registration of ownership transfer for reasons of sale on January 10, 1970 by the former Act on Special Measures for the Registration, etc. of Ownership of Real Estate (Act No. 3094, Jan. 10, 1970) with respect to the area of 3,127 square meters prior to E on July 11, 1981.
(hereinafter referred to as the "registration of transfer of ownership of this case").
The area of 3,127 square meters prior to E was divided into 3,092 square meters prior to E on May 27, 2008 and 35 square meters prior to G.
E. On October 22, 2014, H, I, U.S., U.S., U.S., and J completed each registration of ownership transfer with respect to shares of 16/3,092 shares in the preceding E E’s 3,092 square meters, K in relation to shares of 31/3,092 shares, Samsung E&S Co., Ltd., in relation to shares of 20/3,092 shares, 15/3,092 shares in 15/3,00,000, 32/3,092 shares in the container of the corporation.
F. On October 24, 2014, the area of 3,092 square meters prior to E was divided into 2,908 square meters prior to E (hereinafter “instant land”), 140 square meters prior to L, and 44 square meters prior to M.
G. F, on December 31, 2014, upon completing the registration of ownership transfer based on the partition of co-owned property on December 10, 2014, as to 162/3,092 shares in the name of H, etc. among the instant land, F became the sole owner of the instant land.
H. On January 27, 2015, the Defendant completed the registration of ownership transfer on January 15, 2015 for the instant land.
I. On October 30, 1956, the network D died and inherited the network N's property independently. The network N has died on August 4, 1961, and the plaintiff, P, Q, and R jointly succeeded to the deceased's inheritance shares of the networkO on April 25, 1996 by the plaintiff, P, Q, and R. The deceased on April 25, 1996.
Accordingly, the Plaintiff, P, Q, and R included the instant land in the inherited property.
