피고인은 2013. 6. 6. 06:40경 원주시 B아파트 정문 앞 도로에 누워있던 중 신고를 받고 현장에 출동한 피해자인 원주경찰서 소속 경사 C 및 경사 D에 의해 도로 밖으로 이동하게 되자, 위 아파트 관리반장인 E를 비롯한 행인들이 있는 가운데 위 피해자들에게 “짭새 새끼들아 다 그렇지 야 이 새끼야 니들이 뭔데 씨팔놈들아 나를 죽여라, 내가 욕하든 말든, 좆도 씹 새끼들 씨발 좆같은 것들”이라고 큰소리로 말하여 공연히 피해자들을 모욕하였다.
