Reasons
1. The following facts may be found either in dispute between the parties or in full view of the respective entries in Gap evidence 1 to 5, Eul evidence 1 and 2 (including additional numbers) and the whole purport of the pleadings:
The defendant newly constructed one G apartment, an aggregate building, on each land listed in the attached list owned by the defendant (hereinafter referred to as the "instant site").
B. On February 19, 199, the registration of ownership preservation was completed in the future of the defendant on the separate sections of G apartment, but the registration of site ownership of each sectional building was not completed on the site of this case.
C. On November 5, 2007, Plaintiff A was awarded a bid of Nos. 211, 212, which is a partitioned building of G apartment, in the Daegu District Court and the H real estate auction procedure (hereinafter “instant auction procedure”), and completed the registration of ownership transfer at that time. On April 15, 2008, Plaintiff A was awarded a bid of Nos. 414, 504, 512, and 513 of G apartment at the instant auction procedure and completed the registration of ownership transfer.
C On May 29, 2008, after being awarded a bid of G apartment No. 1004 at the auction procedure of this case, the sale price was paid in full at that time and completed the registration of ownership transfer, the above building was sold to D on June 4, 2008 and completed the registration of ownership transfer in D.
And D on May 3, 2012, sold the above building to Plaintiff A and completed the registration of ownership transfer in the future of Plaintiff A.
E. On May 6, 2008, E was awarded a bid of G apartment No. 912 at the instant auction procedure, paid in full at that time, and completed the registration of ownership transfer, and subsequently sold the said building to F on July 8, 2010 and completed the registration of ownership transfer in F.
And on March 5, 2014, F sold the above building to Plaintiff B and completed the registration of ownership transfer in the future of Plaintiff B.
F. Meanwhile, the proportion of co-ownership shares in the instant site corresponding to the right to use the site of G Apartment Nos. 211, 212, 414, 504, 512, 513, 104, and 912.
