Defendants are not guilty.
Reasons
1. A person who intends to engage in brokerage business shall register the establishment of a brokerage office with the head of a Si/Gun/Gu having jurisdiction over an area which intends to establish a brokerage office as prescribed by Ordinance of the Ministry of Land, Infrastructure and Transport, and a person who is not a broker shall not indicate or advertise the object of brokerage;
가. 피고인 B 1) 피고인은 2013. 12. 17.경부터 2014. 3. 31.경까지 화성시 F, 107동 121호에서 임대인 G 등으로부터 임대차 보증금의 1% 및 월세의 7%를 각각 부동산 임대 수수료로 받고 중개업을 함에 있어 등록관청에 중개사무소 개설등록을 하지 아니하였다. 2) 피고인은 위와 같이 무등록 중개업을 함에 있어 위 일시경 ‘H 월세 임대 중!! H 임대지원센터 I’이라고 적힌 전단지와 ‘병점역ㆍ홈플러스앞 / 월 45만원 풀옵션 오피스텔, H 임대상담 I’이라고 적힌 현수막 등을 이용하여 중개대상물에 대한 표시ㆍ광고를 하였다.
B. Defendant A Co., Ltd., at the above date, at the above time and place, without registering the establishment of a brokerage office with the registration authority as above, and with labels and advertisements on the object of brokerage.
2. Determination
A. According to the records of this case, the following facts are recognized.
1) Defendant A Co., Ltd. (hereinafter “Defendant Co., Ltd.”)
(1) On November 25, 2013, JJ and four parcels of land (hereinafter “instant building”) “K main complex apartment” (hereinafter “instant apartment”) on the ground (231 households, officetels 604 households, sales facilities5 rooms, etc.)
The Korean Land Trust Co., Ltd. entered into a contract on the occupancy management agency for the smooth occupancy promotion of the building.
According to the above contract, the defendant company receives 300,000 won per household for apartments and 400,000 won per household for officetels as an agent for occupancy management, and from the beginning date of occupancy.
