A defendant shall be punished by imprisonment with prison labor for not more than ten months.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. No person, other than an entrusted business entity, who violates the National Sports Promotion Act, or who commits an act of providing property or property benefits to a person who has correctly predicted the outcome by issuing voting rights for sports promotion or things similar thereto, and no person shall open a space for gambling for the purpose of profit-making;

The Defendant conspired with co-offenders, such as C, D, and E, to operate or lose a game machine (F, G) according to the result of the sports game, and made it possible for them to participate in the sports game. According to the above public offering, C, D to invest initial funds, and C, E to operate the above gambling site, and E to manage the general affairs of the Chinese Cheongdo office in which the gambling site server is located, and the Defendant, H, I, J, J, K, and L to work at the Chinese Cheongdo office in which the gambling site server is located, and to manage the impulse and exchange.

Defendant continued to operate the G site from March 23, 2016 to July 3, 2016, while operating the G site from November 18, 2016 to August 4, 2017. From June 26, 2016 to July 3, 2016, Defendant paid KRW 14,709,876,242 in total at 249 times from November 18, 2016 to August 4, 2017, and paid a certain amount of money to members of the sports site in accordance with the actual result of the sports operation.

Accordingly, the defendant, in collusion with C, committed acts similar to the issuance of sports promotion voting rights, and at the same time opened a space for gambling for profit.

2. The Defendant violated the Act on Regulation and Punishment of Concealment of Criminal Proceeds, along with C, E, H, I, J, K, L, M, etc. from March 23, 2016 to August 2017.
