The defendant shall be innocent.
Reasons
1. Summary of the facts charged
A. On July 17, 1999, the Defendant, from the Republic of Korea to the United States on August 2009 and around March 2010, applied for the reissuance of a passport to the Korean consul of the Republic of Korea of the United States Luxembourg, but it was confirmed as a domestic consignee as a result of the identity inspection, and thus it is impossible to have the passport reissued, the Defendant, in collusion with the Defendant’s passport, failed to forge the passport, made the Defendant’s name-free passport slaber, and made the Defendant’s passport “Extension of the passport period” page around March 2010, and then made the Defendant’s passport “SP 10,014” prepared in an irregular manner, and then arbitrarily sealed the Defendant’s seal affixed “LA09-4024” column, and signed the Defendant’s official seal affixed “AUG 14209” with the Defendant’s official seal affixed “in a false way,” with the Defendant’s official seal affixed in advance to “AUG 14009” column.
B. On May 19, 2013, the Defendant presented at the Incheon Airport Entry Inspection Center located in Jung-gu, Incheon, Jung-gu, Incheon, 2850, an employee in charge of the lack of name and exercised the passport, which is a forged official document, as described in paragraph (1), as if it were actually issued.
2. The defendant did not know that the term of validity was extended by requesting the company for issuing the defendant's alleged passport to the agency, and that the passport was forged;
3. According to the evidence duly adopted and examined by the court below, the Defendant entered the instant passport as stated in the facts charged, and applied for the reissuance of the instant passport from the Kyang Viewing Service on June 13, 2013, and returned the instant passport to the Minister of Foreign Affairs on June 14, 2013. The Kyang market discovered that the term of validity of the instant passport was different from that of the passport issued on June 14, 2013, and notified the Minister of Foreign Affairs thereof. The Minister of Foreign Affairs sent the Defendant on June 20, 2013.
