1. 피해자 C에 대한 강제추행 범행 피고인은 2013. 1. 31. 00:10경 안양시 만안구 D에 있는 E역 앞길에서, 피해자 C(여, 19세)이 혼자 길을 걸어가는 것을 발견한 후 피해자에게 접근하여 피해자의 어깨를 손으로 툭툭 치면서 피해자에게 “집에 같이 가자, 이야기 좀 하고 가자”라고 말하며 피해자의 팔짱을 끼려다가, 이에 피해자가 놀라 피고인을 피하여 부근에 있는 ‘F마트’ 안으로 들어가자 주변에서 피해자가 나오기를 기다렸다.

이후 피고인은 같은 날 00:30경 위 마트 옆에 있는 ‘G모텔’ 앞길에서, 피해자의 연락을 받고 위 마트에 온 피해자의 아버지가 피해자와 함께 귀가하려다 피고인에게 “너 무슨 짓을 하려고 그런거냐”고 따져 묻자, 피해자의 아버지에게 “하긴 뭘 하냐, 아무것도 안하려고 그랬다”고 하면서 욕설을 하는 등 서로 대치하다가, 지퍼를 내리고 지퍼 안으로 손을 넣어 성기 부위를 긁는 등의 행동을 하면서 피해자의 아버지가 112신고를 하는 사이에 피해자에게 다가가 피해자의 오른쪽 팔을 잡아당겨 피해자를 끌어안고, 이를 뿌리치는 피해자의 머리채를 붙잡아 당겨 피해자를 주저앉히고, 재차 피해자의 머리채를 잡아 눌러 피해자를 엎드리게 한 다음 피해자의 몸 위에 올라타는 등으로 피해자를 강제로 추행하였다.
