Defendant shall be punished by imprisonment for a term of one year and four months.
Reasons
Punishment of the crime
1. No person in violation of the Game Industry Promotion Act shall provide for distribution or use, display or store game products which have not been rated for such purposes, and shall arrange for exchange or exchange or repurchase of game products which have been acquired through the use of game products or engage in business of purchasing such products for such purposes;
A. From August 15, 201 to October 14 of the same year, the Defendant committed a crime from around August 15, 2011 to around October 14 of the same year, the Defendant carried out an act of exchanging KRW 10,000 on the screen of the game machine when inserting KRW 10,000 without being classified as a class, and then holding KRW 10,00 on the screen of the game machine and holding 10 each time, and then acquiring or losing points according to the combination of the arranged objects or pictures, providing 25 players with 5,00 won per point when the points are displayed on the game screen. The result was that the Defendant carried out an act of exchanging the game product in a manner of deducting 10% from commission to exchange KRW 4,500 after deducting 10% per point 5,00.
B. From November 5, 201 to November 17, 201 of the same year, the Defendant committed a crime from around November 5, 2011 to around November 17, 201, as a business, exchanged the outcome obtained through the use of a game product in the manner of providing 20 games for unspecified multiple customers who did not receive the rating classification at the place specified in the foregoing paragraph (a) in the manner described in the foregoing paragraph (a) and deducting 10% of the score obtained from the game machine from the game machine and exchanging the results.

The Defendant, from November 27, 201 to January 7, 2012, provided 25 units of “sulphy” game not classified at the place specified in the foregoing paragraph (a) from November 27, 2011 to January 7, 2012, for the use of unspecified multiple customers in the same manner as the foregoing paragraph (A), and deducted 10% of the points obtained by customers from the game machine.
