The defendant shall be innocent.

On September 29, 200, around 20:28 on September 29, 200, around 16:12 of the same year, around November 17, 17:04 of the same year, the penal provisions applied to the summary order subject to review on November 23: 2, 2004, which are applicable to the summary order subject to review, lose its retroactive effect in accordance with the Constitutional Court’s decision of unconstitutionality, and thus, the Defendant is acquitted pursuant to the former part of Article 325 of the Criminal Procedure Act.
