A defendant shall be punished by imprisonment for two years.
Reasons
Punishment of the crime
[criminal record] On July 17, 2014, the Defendant was sentenced to three years of imprisonment by the Jeju District Court for a violation of the Act on the Aggravated Punishment, etc. of Specific Crimes (thief) and completed the execution of the sentence on March 20, 2017. On September 13, 2012, the Defendant had four same criminal records including imprisonment with prison labor and one year and six months.
[Criminal facts]
1. Violation of the Act on the Aggravated Punishment, etc. of Specific Crimes;
A. On March 20, 2017, the Defendant: (a) released from the Jeonju prison on March 20, 2017, committed a theft of vehicles necessary for the movement; (b) on the same day, at around 22:00, the Defendant: (c) discovered a DNA device in the amount of KRW 13 million at the market price of the victim C that was parked without correcting the door on the 42-7 street in the Seojinjin-gu Seoul Special Metropolitan City; and (d) drive a vehicle with the speed of KRW 13 million, she loaded into the knife with the key attached to the knife.
B. Accordingly, the defendant habitually stolen the victims' property two times as above.
2. On March 20, 2017, the Defendant violated the Road Traffic Act (unlicensed driving) from around 22:00 on March 20, 2017 to around 05:40 on March 21, 2017, the Defendant: (a) KRW 20km in the front city of the front city from around 42-7 on the street to the road located from around 42-7, Jinjin-gu, Seoul Special Metropolitan City to the 10-ro from the front city of the front city.
