Reasons
Punishment of the crime
- Defendant A’s criminal records - The Seoul Southern District Court sentenced Defendant A to two years and four months of imprisonment for fraud, etc. at the Seoul Southern District Court on February 15, 2006, and was released on May 23, 2007 during the execution of the sentence, and the parole period passed on July 25, 2007.

1. Around June 2008, the Defendant related to defraudation of KRW 230 million of land price, which read, “The victim F, the victim G, and the victim H may be deemed to have a big benefit with a size of 1,655 square meters in size 1,65,00 square meters in the flax, in a real estate office where the name of the Defendant in Cambodian Flaf gue is unknown.”
However, in fact, the purchase price of the above land is limited to approximately KRW 80 million.
Accordingly, the Defendant, by deceiving the victims as above, received 100 million U.S. dollars (US) from the victim F who was a partner of the Defendant, around that time, through I, and received 130 million U.S. dollars from the Defendant’s partner J account (K) on June 25, 2008, and acquired 150 million won, which is the difference between the actual purchase price and the actual purchase price.
2. Around June 2008, the Defendant, with respect to defraudation of KRW 300 million of land price, said victims at the above place, saying, “The said victims would transfer ownership by paying KRW 300 million of the land purchase price at KRW 1,679 square meters in size on the fule book.”
However, there was no intention or ability to transfer the ownership of the above land because the money received from the victims was paid only in part as the purchase price and the remainder was used in another place.
Accordingly, the Defendant, by deceiving the victims as above, received KRW 20 million from the victims H to the new bank account (M) in the name of L on June 20, 2008, and received KRW 300 million from around that time to August 11, 2008.
