A defendant shall be punished by imprisonment for not less than eight months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
From July 10, 201 to December 30, 2013, the Defendant is a person who has been engaged in the delivery and collection of alcoholic beverages products in the (oil) D in Young-gu, Young-gu, Young-si.
1. On July 201, the Defendant supplied alcoholic beverage products to the G cafeteria operated by the victim E in Seongbuk-gu, Sungnam-si, and entered the price of the goods into the device. The facts are as follows: (a) the amount receivable receivable for alcoholic beverages supplied is KRW 1,343,01; (b) 239,500; (c) the recovered public container deposit is KRW 236,500; and (d) the amount of KRW 1,346,01 (1,343,01 KRW 239,50-236,500) should be entered into the above device; (b) despite the fact that the Defendant had to arbitrarily enter the bill of alcoholic beverage sales in KRW 1,371,00; and (c) presented it to the victim as accurately prepared; and (d) had the victim obtain the difference between KRW 1,371,00 and KRW 236,500 by means of credit cards; and (e) had the victim obtain the difference between KRW 36301,29,2981 and KRW 2984.
Accordingly, the defendant had a third party acquire property benefits by deceiving the victim.
2. In the process of supplying alcoholic beverages to the victim H around December 26, 201, the Defendant: (a) supplied alcoholic beverage products at the J operated by the victim H in Gwangjin-gu Seoul Special Metropolitan City, and inputting the cost of goods into the device; (b) provided alcoholic beverage accounts, despite the fact that the amount of the supplied alcoholic beverage accounts is KRW 107,40,00; (c) falsely input the amount of the supplied alcoholic beverage accounts of KRW 263,60,00 ( KRW 107,40,000) and then output the amount of the alcoholic beverage sales account calculated in the sum of KRW 263,60,000 ( KRW 263,60,00) on the day of the supply; and (d) presented it to the victim as accurate.
