A defendant shall be punished by imprisonment for not less than eight months.

The defendant pays 7,481,200 won to the applicant with the money obtained by deception.

Punishment of the crime

[criminal records] On July 20, 2017, the Defendant was sentenced to two years of imprisonment for fraud, etc. at the Daegu District Court, which became final and conclusive on the 28th of the same month. A. On June 30, 2018, the Defendant: (a) purchased a mobile phone pipeline from a sales store to the victim B at the site of replacing apartment pipes in Daegu-gu, Daegu-gu; and (b) paid subsidies to the customer at the sales store; and (c) did not pay subsidies to the customer at the sales store.

If the Korea Communications Commission reports the sales store which does not pay the subsidy, 70,000 won per portable phone can be paid as compensation. Accordingly, the Korea Communications Commission shall report the sales store which purchased the four portable phone and did not pay the four-way face value compensation to the Korea Communications Commission and shall pay the compensation and the mobile phone price.

The phrase “ makes a false statement.”

However, there was no such compensation payment system, and even if the defendant received a portable phone from the injured party, he sold it with a heavy weight and intended to use it individually, and he did not have the intent or ability to pay the victim the price for the mobile phone and the compensation.

As above, the Defendant: (a) deceiving the victim; (b) obtained 1,57,600 Aphone XS 1 on the same day from the victim; and (c) deceiving the victims in a total of 10 times from September 28, 2018 to September 28, 2018; and (d) by deceiving the victims in a total of 14,363,80 won from the market price of the victims.

B. On October 2018, the Defendant had a system of KRW 200 million to receive KRW 300,00 if he sells 300 telephone calls to the victim E in Daegu-gu, Daegu-gu.
