Reasons
Punishment of the crime
In April 2009, the Defendant operated the KT agency at the same place as the above sales store while operating the “E” mobile phone sales store in the building located in Gyeyang-gu, Gyeyang-gu, Seoyang-gu, 2004.
1. In order to attract more customers, the Defendant: (a) was operating a sales store and an agent in the manner that he/she received a high rate of money based on the sales performance from the mobile phone operator in return for the opening of the mobile phone and posted the sales performance of the mobile phone; and (b) was operating the said sales store and agent by receiving a high rate of money based on the sales performance from the mobile phone operator; (c) the continuous increase in the cost of the mobile phone to be paid on behalf of the customers; and (d) was subject to financial pressure, the Defendant would have the new customers return part of the amount of the telephone call via the “humb” service if he/she carries a large number of telephone calls temporarily.
In order to operate the agency in the way of ‘refiscing' method, such as using the mobile phone payment for the existing customers who should pay the mobile phone payment every month after receiving the mobile phone payment in a lump sum, or using it as the store operating expenses.
On February 22, 2016, the Defendant, within the aforementioned “E” business site, and around February 22, 2016, purchased at least three mobile phones from one time to one another, and subscribed to mobile phone services, can obtain a return of KRW 600,00,000, out of each portable phone price of KRW 89,000 from the KT head office through the so-called “E” business site. Thus, the Defendant may purchase a hard portable phone from one another.
In a week, the mobile phone operator opened the mobile phone service for the mobile phone, and the part of the price of the mobile phone for the mobile phone was also returned, and the mobile phone service was falsified.
However, in fact, the KT head office has provided the above whitening service at the time.
