A defendant shall be punished by imprisonment with prison labor for a maximum of eight months and six months.
The defendant is about 40 hours of sexual assault treatment program.
Reasons
Punishment of the crime
On December 20, 2016, the Defendant came to know of the victim D (or 18 years of age) in “C”, a smartphone-rating pole, and received from the injured party a photograph taken of the victim’s chest, including the victim’s chest and the sound, from the victim while exchanging contact with each other via “C”, and had the victim receive a photograph of the victim’s chest and the sound, then the Defendant was able to receive a new photograph or image from the victim by threateninging the victim as if he were circulated to others.
1. No person who violates the Act on Special Cases concerning the Punishment, etc. of Sexual Crimes (obscenity using communications media) shall have the other party reach the other party any words, sounds, letters, pictures, images, or objects that may cause a sense of sexual shame or aversion by telephone, mail, computer or other communications media, with intent to arouse or satisfy his/her or the other party's sexual desire;
On December 31, 2016, the Defendant, at around 02:50 on December 31, 2016, did not send a new photograph of the victim to the victim at the residence of the Defendant located in the Nam-gu Seoul Nam-gu, Gwangju, by photographing a new photograph.
In the end, the victim sent 10 copies of the body photograph taken of the victim's chest, sound, etc., which was transmitted by the victim, and sent the victim the photographs and videos taken of the victim's body body four times from December 31, 2016 to January 7, 2017, such as the list of crimes (1) in attached Form 4.
Accordingly, the Defendant sent to the victim images that may cause sexual humiliation or aversion through the communication media with a view to inducing or satisfying his own sexual desire.
2. On December 31, 2016, from around January 2, 2017 to around January 2, 2017, the Defendant forced the victim to transmit a photograph of the victim’s body to the victim using Mesenger’s Mesenger’s Mesenger’s Mesenger’s Mesenger’s Mesenger’s Mesenger’s Mesenger’s Mesenger’s Mesenger’s Mesen.
