A defendant shall be punished by imprisonment for not less than one year and six months.
Reasons
Punishment of the crime
On January 11, 2008, the Defendant was sentenced to 8 months of imprisonment with prison labor and 200,000 won for larceny, etc., and on February 9, 2010, the Seoul Eastern District Court sentenced six months of imprisonment with prison labor for larceny and completed the execution of the sentence at the Seoul East District Court on June 26, 2010, which became final and conclusive on June 26, 2010. On October 24, 201, the Daejeon District Court issued a summary order of 1,00,000 won for larceny and that of 2,000,000 won for the summary order at the Seoul Central District Court on March 22, 2013, respectively.
Criminal facts
1. Night-time theft of buildings;
A. On March 28, 2013, around 05:20 on March 28, 2013, the Defendant: (a) intruded the victim E’s first floor of the Diplomatic Association located in Silung-si, into the FC page for the operation of the Diplomatic Association in Silung-si; and (b) took one cash 700,000, approximately KRW 120,000, and KRW 33,000,000, in cash owned by the victim and stolen.
B. On April 1, 2013, around 19:00 to 20:00, the Defendant: (a) opened an entrance set up at the victim H management conference on the fourth floor of G building at Heung-si; and (b) intruded into the church to the extent of the church; (c) opened a coffee board at that place; and (d) cut off the victim’s management 1,700 won, which was in that place, by taking the victim’s right in hand.
C. At around 05:30 on April 17, 2013, the Defendant: (a) opened a locked door at K management L located in the Sinsan-siJ; and (b) invaded into the door, and stolen the personal information at which it is impossible to identify the identity of the victim; (c) with one electronic e-mail (SATLE) and any other e-mail on the market price in the U.S. owned by the victim.
2. At around 14:00 on April 9, 2013, the Defendant: (a) opened the door door of the middle gate room in the Sinsan-si M and intruded the victim’s Ncom; and (b) was stolen with one computer, the market price of the victim’s management at which the victim was located in the said place.
