피고인은 2014. 8. 16. 08:10경 서울 중구 세종대로에 있는 한국프레스센터 옆 노상에서, 술에 취해 교황 시복미사 행사에 참석하는 시민들의 안전을 위해 차단벽을 설치하고 경호 경비 업무를 하고 있던 부산연제경찰서 방범순찰대 소속 경위 C에게 “야 이 씹할 놈들아, 왜 지나가는 길을 막고 차단벽을 쳐놨냐, 빨리 치워라”라고 욕설을 하면서 차단벽을 발로 수회 걷어찼다.

Accordingly, the defendant interfered with the legitimate execution of police officers' duties.

2. 모욕 피고인은 2014. 8. 16. 08:30경 제1항 기재 장소에서, 112 신고를 받고 출동한 서울남대문경찰서 D파출소 소속 경위인 피해자 E가 피고인에게 행사장 밖으로 나가 줄 것을 요구하자, 다수의 시복미사 참가자 등이 보고 있는 가운데 피해자에게 “이런 개새끼, 니가 뭔데 지랄이야, 재수 없는 짭새 새끼”라며 욕설을 하였다.

Violence in the crime of obstruction of performance of official duties includes not only the exercise of direct tangible power against public officials, but also the exercise of indirect tangible power, such as Supreme Court Decision 98Do662 delivered on May 12, 1998.
