Defendant shall be punished by imprisonment for not less than two years and six months.

However, the execution of the above punishment shall be suspended for four years from the date of the final judgment.

Punishment of the crime

Defendant is not a narcotics handler.

1. On April 2, 2015, the Defendant, who imported psychotropic drugs, (hereinafter referred to as “philopon”), sent KRW 80,000,00 to the E-mail account (Account Number F) designated by the said seller, by dividing the Defendant’s talking to purchase approximately 0.8g of philopon through the name-free philopon seller and telegram printing display (hereinafter “comgram”) in Gangnam-gu D apartment from Gangnam-gu, Seoul, to the name-free Melopon seller in the Philippines, and then, transferred KRW 80,000 to the E-mail account (Account Number F) designated by the said seller.

After that, the above sellers sent approximately 0.8g of philophones to Korea through international mail, and the Defendant received the cargo from which philophones are concealed in G cafeterias located in front of the above apartment around April 23, 2015.

As a result, the Defendant imported approximately 0.8g of philophones in collusion with a seller in name, and imported philophones into the Republic of Korea from around that time to June 24, 2015, such as the attached crime list (1).

2. On May 8, 2015, the Defendant: (a) obtained a proposal to purchase philophones from the said seller to the said seller during the process of dividing the conversations between the said seller and the telegram in the above apartment building; (b) obtained such a proposal; and (c) remitted KRW 80,000 to the H account designated by the said seller (Ctiti Bank I).

After that, the defendant received 0.8g from the above apartment through the house line, and purchased it.

3. On June 30, 2015, the Defendant: (a) sought the horses from the seller of the above apartment building, which “I think that I will purchase 0.8g of the philopon which I would like to purchase while I would like to purchase the philopon which I would like to purchase, while I would like to purchase 0.8g of the philopon, while I would like to divide the philopon with the seller in the above name of seller and the telegram.”
