A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. Violation of the Act on Special Cases Concerning the Punishment, etc. of Sexual Crimes (hereinafter “Special Cases Concerning the Punishment, etc.”) and the victim B (the age of 43 at the time of the first crime) are the former related persons from April 2016 to February 2018.

No person shall photograph the body of another person, which may cause sexual humiliation or shame, against his/her will, by using a camera or other similar mechanism or apparatus.

A. Nevertheless, the Defendant, at around 11:25 September 4, 2016, worked as a camera of the mobile phone apparatus possessed by D in Incheon Strengthening-gun C, and the Defendant’s main body as a shower after the shower.

The telegraph of the victim was taken against the victim's will.

B. On September 26, 2016, at around 10:37, the Defendant: (a) operated a mobile phone camera function in which it is impossible to identify the number of her trade name located in Sindo-dong-dong-dong-dong-dong-si; and (b) taken photographs of the telegraph of the victim, which is the physical condition, against the victim’s will.

C. On September 26, 2016, around 11:05, the Defendant was above the Defendant.

After working as a camera of a mobile phone device at the location described in the paragraph, the victim was taken against the victim's will to have sexual intercourse with the victim in the physical condition.

Accordingly, the defendant taken the body of the victim who could cause sexual humiliation or shame on three occasions in total, against his will, using a camera, etc.

2. The Defendant of intimidation 1-C at the office of the Defendant’s company located in the Seocho-si Kimpo-si, on June 2018, using a mobile phone device, to the victim’s 1-C at the victim’s office.

In light of the foregoing, as described in the paragraph, the relationship between G and the sexually related images taken against the intent of the above victim and whether they can be connected with G with the company fees (G) close to B.
