A Imprisonment for two years, Defendant B and C shall be punished by imprisonment for one year and six months.
However, as to Defendant B and C, this shall not apply.
Reasons
Punishment of the crime
[2016 Height 707] (Defendant A) The Defendant is a person who manufactures steel structures by employing 22 full-time workers as the representative of (ju) K in the racing and (ju)M, and a person who manufactures steel structures by employing 22 employees.
1. When a worker dies or retires, an employer in violation of the Labor Standards Act shall pay him/her wages, compensations, or other money or valuables within 14 days after the cause for such payment occurred;
Nevertheless, the Defendant did not pay KRW 62,591,135, in total, including the wages of 11 workers and the allowances for unused days during the annual leave of absence on April 11, 2015, as well as the wages of KRW 2,300,00 on April 1, 2015 of the N of Workers who retired on June 11, 2015, within 14 days from the date of each retirement.
2. An employer who violates the Guarantee of Retirement Benefits of a worker shall pay a retirement allowance within fourteen days after the ground for such payment occurred, in case where the worker retires; and
Nevertheless, the Defendant did not pay 141,969,505 won in total, including 3,631,461 won of N's retirement pay retired on June 11, 2015, as well as 1 through 7, 10 through 14, and 22, as well as 13 employees, within 14 days from the date of each retirement.
[1] (1) Defendant A is the representative director of the Victim L Co., Ltd. (hereinafter referred to as “L” or “victim Co., Ltd.”) and M Co., Ltd. (hereinafter referred to as “M”) located in K at the time of racing, who has been engaged in the management and supervision of overall business of each of the above companies, such as fund management of each of the above companies. Defendant B is the managing director of the L Co., Ltd. from January 2010 to March 2015, and Defendant B is the managing director of the above company from March 2010 to March 2015.

C From January 201 to December 2015, 201, C is serving as a director of the corporation headquarters (hereinafter referred to as “O”) from January 201 to December 2, 2015, and P’s facility construction business, management, and subcontractor.
