1. Defendant B:
A. From June 11, 2020 to June 11, 2020, one story of 53.48 square meters among the buildings indicated in the separate sheet from the Plaintiff.
Reasons
Basic Facts
The Plaintiff is the owner of the building indicated in the attached list (hereinafter referred to as the “instant building”), and the Defendants are married as the lessee of the instant building.
1) On February 11, 2015, the Plaintiff is the first floor of Defendant B and the instant building (hereinafter “instant first floor”).
As to the lease deposit, KRW 20 million, monthly rent of KRW 600,000 (repaid on February 25, 201), and the term of lease was set as of February 10, 2017 and entered into a lease agreement (hereinafter referred to as “the instant first-class lease agreement”) (hereinafter referred to as “the following”).
(2) The Plaintiff concluded a lease agreement between Defendant C and the third floor of the instant building (hereinafter “the instant third floor”) up to June 25, 2017, with respect to the lease deposit of KRW 30 million, monthly rent of KRW 400,000 (payment after June 25, 2017), and the lease term of KRW 400,000,000,000 for June 25, 2017.
(B) The Defendant C used the 3rd floor of this case as his residence together with Defendant B.
The Plaintiff and the Defendants have renewed each of the above lease terms with the content of extending the respective lease terms for two years after the expiration of each of the above lease terms.
In 2017, water leakage occurred in the instant building due to a heavy rain around the summer of 2017 and water leakage occurred in the instant first floor and the third floor.
The Plaintiff and the Defendants paid KRW 20 million to the Defendants as agreed money, but the Plaintiff paid KRW 20 million in total as agreed money of KRW 38 million in the lease deposit under the instant 1st floor lease agreement, and the period was modified by the terms of the lease agreement with the content of February 10, 2019.
The defendants paid the difference as stated in the attached rent payment details.
