A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

On April 21, 2005, the Defendant subscribed to 13 insurance products including the purchase of "(Non-Health Insurance) for interesting life", and paid approximately KRW 770,000 as insurance premiums each month, and among them, the Defendant was willing to receive a large amount of insurance money that can be actually paid due to long-term hospitalization, even though it is possible to receive a large amount of insurance money that can be actually paid due to long-term hospitalization.

Therefore, the Defendant, for about 20 days from March 24, 2008 to April 12, 2008, was hospitalized in the name of “D Council member” located in the Busan Sho-gu, Busan, under the circumstances where it is possible to receive medical care,” and subsequently, on April 21, 2008, filed a claim for insurance money with the victim interesting P&C Co., Ltd. (hereinafter "AI Damage") in total, acquired KRW 70,003,155 won in total from eight insurance companies, such as the victim's interest country life insurance company ("SG damage").

[In regard to this, the defendant/defense counsel has no intention to commit fraud since he/she was hospitalized due to the necessity of hospitalized treatment.
