A defendant shall be punished by imprisonment for three years.
However, the execution of the above punishment shall be suspended for four years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
[2019Gohap263] No person other than a person handling narcotics shall trade or administer psychotropic drugs, and no person shall trade, smoke, or possess them for smoking.
Defendant is not a narcotics handler.
1. On October 12, 2019, the Defendant purchased psychotropic drugs and marijuana trade: (a) 4-5 grams of psychotropic drugs, psychotropic drugs, and synthetic marijuana (i.e., 4F-MDB-BUACA; (b) 4-5 grams; (c) 7 grams of similar chain in JWH-018; hereinafter referred to as “maW-018; hereinafter referred to as “marisis”); (d) 3,50,000,000,000,000,000,000 won; and (b) the Defendant promised to purchase psychotropic drugs, which were searched at a place designated by the seller; and (c) the Defendant paid the price at a place designated by the seller; and (d) the Defendant promised to trade psychotropic drugs in so-called manner as to find goods.
around that time, the Defendant contained KRW 3.5 million in cash in an intel in Gangnam-gu Seoul, Gangnam-gu, Seoul, and found each of the above narcotics, etc. in a nearby officetel that was designated as a narcotics storage place.
Accordingly, the Defendant traded psychotropic drugs and marijuana.
2. On the same day as the statement in paragraph (1), the Defendant: (a) inserted one marijuana car knife, which he purchased as described in paragraph (1), into an electronic tobacco, in his car parked in the F (Sapcheon-gun) parking lot located in Pyeongtaek-do, Pyeongtaek-gun; and (b) smoked twice in a flife quantity.
Accordingly, the Defendant smoked marijuana.
3. On October 15, 2019, the Defendant for trade of psychotropic drugs and marijuana: (a) on the same date, from the sales books of the same name as those described in paragraph (1), the Defendant purchased and sold any psychotropic drug and the psychotropic drug in the form of 6g of synthetic marijuana and 4 liquid marijuana storages in capacity in the same manner as described in paragraph (1).
