Defendant shall be punished by imprisonment for a term of one year and six months.
Reasons
Punishment of the crime
1. On September 14, 2017, the Defendant was sentenced to one year of imprisonment for fraud at the Busan District Court, and completed the execution of the sentence on July 3, 2018.
2. Criminal facts;
A. Fraud (1) around 04:00 on August 5, 2018, the Defendant: (a) placed an attitude as if the Defendant would normally pay the price to the victim; (b) placed an attitude as if he would pay the price to the victim; and (c) obtained the payment from the victim, who received the payment of the price from the victim under the Plaintiff’s “Ding shop” operated by the Plaintiff Co., Ltd. (M, 62 years of age); and (d) took the same as if he would pay the price to the victim; and (e) obtained the payment from the victim, he/she received two copies of the two copies of the total amount of KRW 300,
(B) around 02:00 on October 9, 2018, the Defendant: (a) did not have the intent or ability to pay the amount, even if having been provided with alcoholic beverages, etc., from “G” operated by the Victim F (the 41 year old), the Defendant placed an attitude as if the Defendant would normally pay the amount to the victim; (b) placed an order with the subject and beer, etc.; and (c) received from the victim the amount of KRW 150,00 in total, 1500,000,000 from the victim; and (d) obtained pecuniary benefits equivalent to the same amount of money.
(2) On September 24, 2018, the Defendant: (a) around 23:30 on September 24, 2018, at the main point of “J” administered by the victim I (n, 60 years of age) on the first floor of the H-owned building of the Geum-gu Busan, the Defendant placed an attitude as if the victim would normally pay the amount; (b) placed an order on both owners, etc., of which the victim would have had no intent or ability to pay the amount; and (c) received the amount of money as if the victim would pay the amount normally; and (d) received the amount of money equivalent to KRW 420,00,00 from the victim, and acquired economic benefits equivalent to the same amount of money.
B. Violence (2018 Highest 4557) Defendant on September 9, 2018, on the ground that around 05:30 on September 9, 2018, the victim M (36 years of age) expressed a desire for an old female woman.
