피고인은 2014. 5. 10. 15:00경부터 17:00경까지 위 회사 사장실에 포토샵 프로그램을 가르쳐 달라며 피해자를 부른 후 컴퓨터 책상 앞에 앉은 피해자의 옆에 앉아 한손으로 피해자의 양손을 잡고 한손으로 피해자의 목덜미를 잡아 피해자의 입안에 자신의 혀를 밀어 넣어 강제로 키스를 하고, 이에 피해자가 “사장님, 하지 마세요.”라며 반항하였지만 “잠시만, 한번만, 괜찮아”라고 하면서 피해자의 상의 위쪽으로 손을 넣어 피해자의 양쪽 가슴을 만지고, 계속하여 등 뒤에서 피해자의 상의 안으로 손을 넣어 브래지어 후크를 풀은 뒤 손으로 피해자의 가슴을 주무른 다음 의자에 앉은 상태에서 피해자를 피고인 앞으로 서게 하여 피해자의 상의 단추를 2개 풀고 손으로 피해자의 가슴을 만지고 재차 강제로 키스를 한 뒤 혀로 피해자의 목과 가슴을 핥고, 팬티 안으로 손을 넣어 피해자의 엉덩이를 만지는 등 피해자를 강제로 추행하였다.
