Defendant shall be punished by a fine of five million won.
If the defendant does not pay the above fine, KRW 100,000.
Reasons
Punishment of the crime
Any person who intends to import goods shall report to the head of any customhouse the name, standard, quantity and price of such goods and other matters prescribed by the Presidential Decree, and in case of postal materials shipped into Korea for sale, an import declaration thereon shall be filed without fail.
Nevertheless, the Defendant, in relation to China’s nationality’s “B,” as if the “B” was an international postal item for the purpose of self-use of a small amount of personal purchaser of Korea in China, and if the goods were distributed to Korea, the Defendant received it and conspired to send it to the domestic address designated by the “B”.
Therefore, around August 29, 2018, the above "B" divided parcels 140 km, melting 70 km, 70 km, Yanan 70 km, and 14 tobacco 14 km into 14 pieces (10 km, melting 10 km, melting 5 km, Kagoan 5 km, Kagoan 5 km, and 2 Packaging) at a place where it is impossible to know at the same time as it is for small-sum self-use in China, and then divided them into C, D, "E," "F," "G," "H," and "J," and the defendant received the above parcel 14 items brought into Korea through the Busan International Customs Office from the defendant's dwelling, and then received them from the defendant's dwelling, "Y," and "Y, Incheon, Dong-dong," and then, received them to the defendant's dwelling, "Y, and Dong-dong" in Incheon.
Accordingly, the Defendant imported 881,580 won of the cost of goods for sale (3,634,540 won at the market price) without filing an import declaration, in collusion with “B”, by distributing 140 km, melting 70 km, 70 km, tobacco 14 km, and then distributing as if they were for the purpose of self-use of small amount.
In addition, the Defendant, in collusion with “B” from August 29, 2018 to September 27, 2018, in an amount equivalent to KRW 19,298,850 (domestic market price of KRW 78,207,758) of the cost of the relevant goods, such as the written list of crimes in the attached Form from August 29, 2018 to September 27, 2018.
