Punishment of the crime
[Criminal Power] On June 22, 2018, the Defendant was sentenced to imprisonment with prison labor for fraud, etc. at the Seoul Northern District Court on the 30th day of the same month, and the judgment became final and conclusive.
【Criminal Facts】
1. Embezzlements of lost possession;
A. On February 16, 2018, around 06:00 on February 16, 2018, the Defendant acquired a copy of the modern card (E) lost by the victim D in the front of Eunpyeong-gu Seoul, Eunpyeong-gu, Seoul.
The Defendant did not take necessary measures, such as returning the acquired property to the victim, but did so.
Accordingly, the defendant embezzled the property that has been separated from the possession of the victim.
B. On February 24, 2018, around 04:00 on February 24, 2018, the Defendant acquired one card (I) lost the victim H in the front of G in Eunpyeong-gu Seoul, Eunpyeong-gu, Seoul.
The Defendant did not take necessary measures, such as returning the acquired property to the victim, but did so.
Accordingly, the defendant embezzled the property that has been separated from the possession of the victim.
2. Fraud and violation of the Specialized Credit Finance Business Act;
A. On February 16, 2018, the Defendant purchased one cigarette at the L convenience store operated by Eunpyeong-gu Seoul, the Eunpyeong-gu J and the victim K on the first floor on February 16, 2018, and received KRW 785,970 won in total at 29 times in total, as indicated in the list 1 of the crime committed on the same day, by presenting the said D’s modern card to its employees, as described in the above paragraph 1 (a) and allowing them to settle the account.
Accordingly, the defendant deceiving the victims, received property from the victims, and used the lost credit card unlawfully.
B. On February 24, 2018, the Defendant purchased 1 and 1 smoke from the O convenience store operated by the victim N in Eunpyeong-gu Seoul, Eunpyeong-gu, Seoul around 04:50 on February 24, 2018, at around 04:50 on February 24, 2018.
