1. Defendant B’s KRW 99,471,372 as well as 6% per annum from January 4, 2017 to April 19, 2017 to the Plaintiff.
Reasons
1. The description of the grounds for the claim shall be as specified in the attached Form;
2. Claim against Defendant B: Judgment by public notice (Article 208 (3) 3 of the Civil Procedure Act).
3. On the premise that Defendant C operated D with Defendant C, the Plaintiff’s claim against Defendant C is jointly and severally filed with Defendant C, but there is no evidence to prove the fact that Defendant C operated D with Defendant B. Thus, the Plaintiff’s claim against the Defendant C premised on this premise cannot be accepted.
4. The plaintiff's claim against the defendant B is justified, and the claim against the defendant C is dismissed as it is without merit.
