1. The plaintiff's claim is dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. The parties' assertion
A. The Plaintiff’s assertion: (a) transferred KRW 100,820,666 in total on 39 occasions between July 25, 2012 and September 4, 2014 to the Defendants’ account as indicated in the table below; (b) however, the Defendants were obligated to pay the Plaintiff the outstanding loan amounting to KRW 56,138,00,000 and delay damages therefrom; and (c) the Defendants conspired to manage the Plaintiff’s financial management by proxy.
The defendants asserts that they are jointly liable to pay the plaintiff 56,138,000 won and damages for delay due to the illegal act, because they deceiving the plaintiff by means of lending or receiving money, etc.
