A defendant shall be punished by imprisonment for not less than one year and six months.

Of the facts charged in the instant case, the fraud of the victim C on June 8, 2013, was committed.

Punishment of the crime

The Defendant, from January 1, 2012 to November 19, 2013, worked as the head of the business office, etc. at E Co., Ltd. (hereinafter “E”) that manufactured cosmetics, and was engaged in the business of selling cosmetics, customer management, etc.

1. On October 31, 2013, the Defendant, by using computers, etc., made the victim process as if the victim actually purchased cosmetics and paid 3,000,000 won to pay the credit card use payment amount, and made E obtain economic benefits equivalent to the same amount by having the victim obtain economic benefits by having the victim pay 3,00,000 won.

2. Fraud;

A. On May 2, 2013, the Defendant stated that “Around May 2, 2013, the Defendant would immediately cancel the settlement with a credit card as if the Defendant purchased cosmetics, thereby raising the purchase performance at the time of settling the settlement with a credit card, and immediately cancel the settlement.”

However, the defendant did not have an intention or ability to cancel the settlement of credit cards by the victim only with the mind of raising his sales performance.

Nevertheless, on May 2, 2013, the Defendant: (a) by deceiving the victim; (b) caused the victim to pay 1.6 million won by the Samsung Card Company’s credit card as the price for cosmetics on May 2, 2013; and (c) accordingly, corrected the date and time of the crime in attached Table 1 until November 14, 2013.

In a similar way, the attached Table 2 of the indictment prior to the change of the list of crimes in attached Form 1 is applicable.
