Punishment of the crime

The Defendant is the head of Chungcheongnam-si, Chungcheongnam-do, and D is the person who works as the head of Boan Branch Office of G, Inc., a “F” agent in E.

The "Support Project for Agricultural Machinery and Materials in an area adjacent to a power plant in 2014" is a subsidy program that enables a village to receive subsidies for agricultural machinery if a village purchases agricultural machinery and equipment jointly used in the name of a village in an area adjacent to a power plant under the Act on Assistance to Electric Power Plants. In order to receive the above subsidies, if the agricultural machinery and equipment are purchased in excess of KRW 20 million in the purchase price, it shall be requested for viewing by the Decree, but if 30% of the purchase price is borne by the person, it may be purchased by a contract.

In order to purchase agricultural machinery exceeding KRW 20 million from D and F’s above “F” through a contract method, the Defendant was willing to unlawfully receive subsidies by submitting false evidentiary data on self-payment as if he purchases agricultural machinery, other than those actually purchased, in order to purchase agricultural machinery in excess of KRW 20 million.

In D and on October 23, 2014, the Defendant would operate a subsidy program that purchases agricultural machinery with a subsidy of KRW 23,500,000,000,000,000 at a discount of KRW 23,50,000,000,000 from D, while H, a resident of C, decided to purchase the agricultural machinery at a discount of KRW 23,50,000,000,000,000,000,000,000 won, 23,50,000,000,000 won.

A subsidy application, an application for the purchase of agricultural machinery, and an application for subsidy support were submitted.

D On December 15, 2014, from the Agricultural Cooperative Account in the name of the KFFFF to the Agricultural Cooperative Account in the name of the Defendant (J) in the name of the subsidized project operator, D continued to deposit KRW 3.6 million, and make a false transaction statement by receiving it again to the same account, and shall raise the subsidy amount of KRW 19.9 million with the re-paid project cost, KRW 3.6 million with the self-paid project cost, KRW 23.5 million with the total project cost.
