1. The Defendant’s disposition imposing a penalty surcharge on the Plaintiff on February 1, 2017 is revoked.

2. The costs of the lawsuit are assessed against the defendant.

Details of the disposition

On March 5, 2009, the Plaintiff was designated as a long-term care institution under Article 31 of the Act on Long-Term Care Insurance for Older Persons (hereinafter “Medical Care Insurance Act”) for the Long-term Care Center for Older Persons B (hereinafter “the instant medical care institution”), which was operated by the Defendant as the representative of the instant medical care institution from around that time.

(A) (No. 1) Disposition ground: (i) Claim 34,714,460 won for a violation of the criteria for assignment of human resources (D, 63 years) was 4,00 days each month from October 2013 to January 1, 2014, and 128 to 160 hours each week; and (ii) Social Workers E (E, 80 years) reported that he/she had worked for at least 160 hours each month while he/she had worked for at least 120 hours each month on October 20, 2014; and (iii) reported that he/she had worked for at least 160 hours each month on the ground that he/she had received expenses for additional assignment of human resources from the Health Insurance Corporation (E, 80 won to 160% each month on the ground that he/she had received expenses for additional assignment of human resources from the Health Insurance Corporation by 160% on the ground that he/she did not apply the reduction of expenses for additional assignment of human resources.

Eul evidence Nos. 3 and 4 of each of the following dispositions are "the ground for the first disposition of this case", and "the ground for the second disposition of this case" is "the ground for the second disposition of this case".

Article 37 of the Medical Care Insurance Act, on February 1, 2017, on the ground that the Plaintiff rendered each of the instant dispositions, on the grounds of the instant disposition.
