A defendant shall be punished by imprisonment for six months.
Reasons
Punishment of the crime
From December 9, 2008, the Defendant is a fire-fighting public official, a person who has served in the C Fire-Fighting Department as a fire-fighting officer, and a person who is engaged in the duties of receiving the cost of treating civil petitions.
1. Around January 7, 2011, the Defendant, without using public charges (such as electric charges, communications charges, gas charges, etc.) used in C Fire Fighting Book on December 2, 2010, set up a statement of account transfer for cash withdrawal in the name of a local finance management system, and voluntarily submitted 850,000 won to the Nonghyup Bank that manages the account of cash withdrawal other than the revenue and expenditure of the said fire fighting department, and then withdrawn KRW 850,00 from the Eth day thereafter.
In addition, from January 7, 201 to September 12, 2013, the Defendant: (a) withdrawn KRW 110,408,570 in total over 127 occasions, as indicated in the budget cash withdrawal list of crimes in attached Form C fire-fighting notes, from around January 7, 2011 to around September 12, 201; and (b) used them for personal purposes, such as gambling funds, such as sports soil, living expenses, etc.
2. On June 24, 201, the Defendant prepared a statement of account transfer under the name of the disbursement officer, without using “E-ho”, which is a local finance management system, at the same place as before and after the preceding paragraph, and submitted it to the Nonghyup Bank that manages the account of cash receipts and disbursements from the revenue and expenditure of the said fire station, and received KRW 100,000 from that time to August 26, 2013, including the above account from August 26, 2013, the Defendant’s deposit account in the name of the Defendant, the Nonghyup Bank (G), the National Federation of Agricultural Cooperatives under the name of the Defendant, the Deposit Bank under the name of the Defendant, the Nonghyup Bank under the name of the Defendant’s father (K), the Defendant’s deposit account (M, N), and the Defendant’s bank account in the name of the Defendant’s father, each transfer of KRW 283,90,50,00 over 179 times, such as the budget transfer list of private bank accounts in the name.
