A defendant shall be punished by imprisonment for not more than ten months.
Reasons
Punishment of the crime
Around May 2008, the Defendant, as the husband B and the victim C are running real estate business, committed as if they obtained a large amount of income through credit business, and was willing to obtain a large amount of profit every month when investing in credit business, by deceiving the victim C to receive money under the pretext of borrowing money.
1. On May 2008, the Defendant made a false statement to the effect that “If the husband’s husband’s husband’s husband’s family village engages in the credit business at F Casino, 200 million won will make interest per month if he/she borrowed KRW 20 million, he/she would make a second million interest.”
However, in fact, the Defendant and B did not have any specific property or income at the time, and they did not have worked as the head of the business headquarters in G as stated in the above order, and they did not have any existing obligation, and they did not have to use the account under the name of H, the birth of the Defendant, as the provisional attachment of B’s account was made. As such, even if they borrowed money from the victim, they did not have any intent or ability to pay interest to the victim or to repay the principal.
Nevertheless, the defendant and B are accused of the victim and are subject to such deception from the victim.
5. A receipt of KRW 20 million from around 30.3 to a new bank account with the name of the defendant in the above H as a loan.
Accordingly, the defendant, in collusion with the victim B, was accused of 20 million won from the victim by deceiving the victim.
2. The Defendant’s false statement to the effect that, in the J, which is located in B and B, the Gangwon-do Police Officer I in Gangwon-do on August 2008, the Defendant: (a) sought to receive interest from the private village students running credit business; (b) but, on the other hand, he refused to provide a loan of KRW 20 million that he/she borrowed before he/she intended to engage in credit business in the F Casino; and (c) if he/she lends an additional amount of KRW 80 million,000,000 per month, 8 million per month.
