Reasons
Punishment of the crime
1. Defendant A proposed to register under the name of the I Trading Company (hereinafter “I Trading Company”) operated by H in order to sell a taxi restoration vehicle and a limited LPG car, etc. to the general public. Defendant A accepted this condition on the condition that H receives fees equivalent to KRW 20-3 million per vehicle.
Accordingly, H at the registration system of Naju-si, which was located on April 26, 2011, 201, Naju-si, Naju-si, and the fact is as follows: (a) as if he purchased the said vehicle without having purchased the said vehicle as a product vehicle at the trading company, H falsely prepared an application for the registration of transfer and registration of ownership of the said vehicle and a certificate of transfer of the said vehicle; and (b) had the pertinent public official in charge register the said vehicle as an owner of the I Trading company in collusion with H in collusion with H, from April 26, 2011 to December 11, 2013; and (c) the Defendant had the said public official in charge enter the 111 vehicle in the electronic records register by filing a false report with respect to the total of 11 vehicles as shown in the list of crimes, and exercised the electronic records by using the false information recorded in the office of the said vehicle at that time.
2. On August 3, 2011, Defendant B conspired with H to make a false application for transfer registration in the name of the I Trading Company, as if he purchased K New Airport franchise in the trading company without purchasing a vehicle. From August 3, 2011 to March 4, 2015, the Defendant reported false facts with respect to the total eight vehicles from August 3, 201 to March 4, 2015, and made the electronic records recorded in the electronic records register of the vehicle, which was an official electronic record, to record the false facts in the electronic records register of the vehicle, and around that time, exercised the electronic records by keeping the records recorded false facts in the said vehicle registration office.
