A defendant shall be punished by imprisonment for not less than one year and six months.

The defendant shall be ordered to complete the sexual assault treatment program for 80 hours.

Punishment of the crime

1. Around May 21, 2019, the Defendant violated the Act on Promotion, etc. of Information and Communications Network Utilization and Information Protection (Defamation) published a statement on the following bulletin: (a) on the Defendant’s house located in the Sinsan City B apartment C, and (b) on the victim E (the 16-year age), and Kakakao Stockholm, which became aware of through the paper, refused the Defendant’s request for sexual intercourse; (b) on the part of the Defendant, the victim refused the Defendant’s request for sexual intercourse; and (c) on the part of the Defendant’s cell phone for the purpose of slandering the victim, even though the victim did not have sexual intercourse but did not have sexual intercourse, the victim was connected to the Defendant’s Pice account using a mobile phone for the purpose of slandering the victim; and (d) on the

Accordingly, the defendant has damaged the reputation of the victim by divulging public false information through the information and communication network for the purpose of slandering the victim.

2. 강요 피고인은 2019. 5. 21. 20:30경 위 피고인의 주거지에서, 위 1항 기재와 같이 페이스북에 피해자의 명예를 훼손하는 내용의 글을 게재한 화면을 캡처하여 피해자에게 카카오톡으로 전송한 다음 “알몸사진을 보내지 않으면 학교로 찾아가 깽판치고 걸레라고 소문을 내겠다. 지금 바로 인터넷에 네 정보를 모두 퍼뜨리고 페이스북 게시글을 삭제하지 않겠다.”라고 협박하여 이에 겁을 먹은 피해자로 하여금 피해자의 가슴과 음부를 촬영한 사진을 카카오톡을 이용하여 피고인의 휴대전화로 전송하게 하여 의무 없는 일을 하게 하였다.

3. Around May 21, 2019, the Defendant, in violation of the Act on the Protection of Children and Juveniles against Sexual Abuse (obscenity possession), sent a photograph of the victim’s chest and fry, such as the above paragraph (2), to the cellular phone of the Defendant, at around May 21, 2019.

As a result, the defendant is exposed to the chests and fluor, part of the body of the victim who is a child or juvenile, so that sexual humiliation is made.
