A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

The Defendant was a graduate line from the Kdong-ri “L” University, and the victims belonged to the same dong-ri that was enrolled in the above university, and on May 2, 2015, the victims were in the Nle-ri’s Nle-ri’s population M in Gyeonggi-si, Gyeonggi-do.

1. At around 01:00 on May 3, 2015, the Defendant: (a) placed the victim’s O (n, 23 years of age) and the victim’s P (n, 21 years of age) with the Defendant under the influence of alcohol; (b) placed the victim’s O on the part of the Defendant; (c) placed the victim’s O on two occasions in the part of the Defendant; and (d) placed the victim’s O on the part of the victim’s her hand on two occasions; (c) placed the victim’s O on the part of the victim’s right; and (d) placed the victim’s O in one hand on two consecutive occasions; and (d) used the victim’s her hick on two occasions from the left side of the victim’s P to the right side of the road.

Accordingly, the defendant committed an indecent act against the victimO and P respectively.

2. 피고인은 위 1항 기재와 같은 날 01:30경 위 N 펜션 침대 방에서 나와 거실에 있는 피해자 Q(여, 21세)의 손을 잡고 손등에 1회 입을 맞추고, 피해자의 얼굴을 당겨 왼쪽 볼에 1회 입을 맞추고, 계속하여 산책을 가기 위해 위 펜션 출입구에서 신발을 신는 위 1항 기재 피해자 O의 왼쪽 엉덩이를 만진 후 위 출입구 밖으로 나가 피해자 Q을 양팔로 감싸 안고 머리에 입맞춤을 하고, 피해자 Q이 이를 거부하며 양손으로 피고인의 어깨를 밀쳤음에도 오른손으로 피해자 Q의 왼쪽 가슴을 움켜쥔 후 다시 오른손으로 피해자 Q의 왼쪽 가슴을 밑에서 위로 쓸어 올리듯이 만졌다.

Accordingly, the Defendant committed an indecent act against the victim O and Q respectively.
