1. It was prepared on October 1, 2019 by the said court with respect to the case of Suwon District Court C real estate auction.
Reasons
1. Facts of recognition;
A. On January 16, 2018, each real estate listed in No. 1, 4, and 6 of the [Attachment List No. 1] in the name of D Co., Ltd. (hereinafter “instant real estate”) and each real estate listed in No. 2 and 3 of the [Attachment List No. 1] in the name of E Co., Ltd. (hereinafter “second real estate of this case,” and the combination of the above real estate was referred to as “each real estate of this case”), the registration of provisional disposition by the Plaintiff (hereinafter “provisional disposition of this case”) was completed.
B. As to the instant real estate No. 1 on February 9, 2018, Defendant Leecheon-si completed the seizure registration as to the instant real estate No. 2 on July 26, 2018.
On July 25, 2018, on the application for voluntary auction by the FF association, which is the right to collateral security, the voluntary auction procedure (hereinafter “instant auction procedure”) began with regard to each of the instant real estate.
C. On February 20, 2019, the Plaintiff was rendered a favorable judgment in the principal lawsuit on the instant provisional disposition (Yan District Court Branch 2018Gahap5033). The said judgment became final and conclusive on April 2, 2019.
Accordingly, on June 27, 2019 and July 11, 2019, the registration of transfer of ownership in the name of the plaintiff was completed due to the termination of delegation contract with respect to each of the instant real estate, and the registration of seizure in the name of the defendant Leecheon-si, the National Health Insurance Corporation was cancelled due to the invalidation of the provisional disposition in this case.
The grounds for the distribution order of creditors are as follows: (a) Defendant Korea Workers’ Compensation & Welfare Corporation (substitute for another person; (b) the person holding the right to demand a distribution of KRW 4,293,770,000 (tax; and (c) Defendant Korea (tax; 2 real estate in this case) 53,464,970 (tax; 1 real estate in this case) Defendant Leecheon-si 53,464,970 (tax; 2 real estate in this case); (d) Defendant National Health Insurance Corporation (Seoul Vice Governor) 8,569,960 won (public charges; and (e) Plaintiff 165,568,063 won (public charges; 2 real estate in this case); and (e) the surplus of the third acquisitor, who
