1. The plaintiff's appeal is dismissed.
2. The costs of appeal shall be borne by the Plaintiff.
The purport of the claim and appeal is the purport of the appeal.
Reasons
1. Basic facts
A. 1) Nonparty D and E (hereinafter “D, etc.”)
(2) On February 20, 1989, the sales contract was to purchase the instant land and each of the lands listed in the separate sheet (7 parcels) from Nonparty F in the purchase price of KRW 89 million (20,000,000,000) (hereinafter “instant sales contract”).
(2) At the time of the instant sales contract, the agreement was made to pay each of the down payment KRW 10 million on the day of the contract, the intermediate payment of KRW 30 million on March 10, 1989, and the remainder of KRW 49 million on March 31, 1989. (2) However, at the time of the instant sales contract, the land indicated in paragraph (1) of the attached Table included the content that “the grave was in existence at the time of the instant sales contract, and the area was approximately KRW 450,00, the purchase price was KRW 89,000, the sales price was KRW 89,000,000,” and the said sales contract included the content that “an increase or decrease in the usual price according to the increase or decrease in the usual number at the time of
3) F was paid KRW 8,534,00 by receiving the down payment of KRW 10 million on the date of the instant sales contract, KRW 30 million on March 11, 1989, KRW 45,340,000,000 from the intermediate payment of KRW 30,000 on April 20, 1989, and KRW 8,5340,000. (B)D, etc. received each of the lands listed in the separate sheet on the grounds of the instant sales contract, for each of the lands listed in the separate sheet on April 21, 1989 (attached Form No. 1, No. 13200, Apr. 21, 1989 (attached Form 1, No. 1, No. 13202), respectively, and completed the registration of ownership transfer.
2) D’s death on June 26, 2008. D’s wife Nonparty G, one of the decedent, completed the registration of transfer of ownership on July 31, 2008, received on May 21, 2010, by the Changwon District Court, Jinju Registry, received on July 31, 2008, due to the inheritance by agreement division, as to D’s 1/2 shares of each real estate indicated in the separate sheet. 3) The Plaintiff of the wife, one of the decedent, died on May 21, 2010. The Plaintiff of the wife, one of the decedent, was the Changwon District Court, Jinju Registry, and received on June 23, 2010, as the registration of transfer of ownership by agreement division.
