Reasons
Punishment of the crime
1. Any person who intends to run the real estate brokerage business for joint crimes with G shall register the establishment of a brokerage office with the head of a Si/Gun/Gu having jurisdiction over an area where he/she intends to establish a brokerage office in accordance with the Ordinance of the Ministry of Oceans
However, on August 25, 201, the Defendant did not register the establishment of a brokerage office with G, and, at the office of “IJ” located in Seo-gu, Seo-gu, Seo-gu, Seo-gu, Seo-gu, in the operation of G around August 25, 2011, entered into an investment agreement to jointly purchase and distribute profits from “Lina” located in Cheong-gu, Seo-si, Seo-si, and subsequent sales agreement to jointly purchase and sell “Lina-do” between M (B) and N, and subsequent sales agreement to sell and purchase real estate at KRW 235 million between N, and received KRW 40 million from N as a new bank account in the name of the Defendant, around August 30, 2011.
Accordingly, the Defendant conspiredd with G to run real estate brokerage business without registering the establishment of a brokerage office.
2. A person who intends to run the real estate brokerage business for the sole crime shall register the establishment of a brokerage office with the head of a Si/Gun/Gu having jurisdiction over an area where he/she intends to establish a brokerage office under the conditions as prescribed by Ordinance
Defendant 1 without being registered as a brokerage office;
A. On April 25, 2011, in the office of mutual infinite-gu P apartment complex located in the Seocho-gu P apartment complex in Cheongju-si, Seo-gu, Seoju-si, the sales contract was arranged for the sales contract to sell Q to N for KRW 140 million and KRW 800,000,000,000 from the above N for brokerage fees, namely, the sales contract was received from N for the sales contract to sell Q to N for KRW 104 million;
B. A law firm located in R on September 29, 201, around 14:00, in order to arrange for a sales contract to sell “843 square meters of the right to sell the land for consultation in Cheongju-si T” owned by S to N for KRW 33 million, and the said N for brokerage commission.
