Punishment of the crime

1. 성폭력범죄의처벌및피해자보호등에관한법률위반(장애인강제추행), 성폭력범죄의처벌 및피해자보호등에관한법률위반(13세미만미성년자강간등) 피고인 겸 피부착명령청구인(이하 ‘피고인’이라 한다)은 2013. 8. 14. 03:00경 이천시 중리동 소재 이천 시외버스터미널 근처에서 지능지수 60, 사회연령 7세 6월 정도로서 지적장애 아동인 피해자 C(12세)가 가출하여 돌아다니는 것을 보고 ‘김밥과 라면을 사주겠다’며 피해자에게 접근하여 이천시 부발읍 소재 무촌리 부발종합운동장에 있는 벤치로 데리고 간 후 그곳에서 피해자의 바지 속으로 손을 넣어 성기를 만지고, 이에 피해자가 하지 말라고 하였음에도 계속하여 ‘내가 괜히 김밥 사준 줄 알아, 보답을 해야지, 맞을래’라고 협박하며 계속하여 피해자의 성기를 만져 발기시킨 후 성기를 잡고 위, 아래로 흔들어 추행한 것을 비롯하여 별지 범죄일람표 기재와 같이 그 무렵부터 2013. 8. 18.경까지 총 3회에 걸쳐 13세 미만의 미성년자인 동시에 정신적인 장애가 있는 피해자를 추행하였다.
