A defendant shall be punished by imprisonment for not more than ten months.

1. 공무집행 방해 및 상해 피고인은 2015. 12. 29. 22:33 경 안양시 동안구 C에 있는 D 식당 앞 도로에서 E과 시비가 일어 서로 다투던 중 신고를 받고 출동한 안양동안경찰서 F 파출소 소속 순경 피해자 G 등 경찰관들과 함께 순찰차에 탑승한 다음, 같은 날 22:50 경 안양시 동안구 H에 있는 F 파출소 앞에 이르러 피해 자가 폭행 부위에 대해 묻자, “ 이래서 짭새 새끼들 안 돼, 내가 만취했는데 내가 누구한테 어디를 어떻게 맞았는지 기억해야 해 ”라고 말하며 순찰차 뒷좌석 천장을 주먹으로 치고, 순찰차에서 내려 F 파출소 안으로 들어가다가 “ 이 개새끼들!” 이라고 욕설을 하며 오른손에 들고 있던 휴대폰 보조 배터리로 피해자의 뒷머리를 1회 때려, 112 신고 사건 처리에 관한 경찰관의 정당한 직무집행을 방해함과 동시에 피해자에게 약 10일 간의 치료를 요하는 좌측 후두부 좌상을 가하였다.
