1. Defendant B Co., Ltd.:
A. On February 25, 2014, concerning the real estate listed in paragraph 1 of the list of real estate attached hereto.
Reasons
1. Facts of recognition;
A. While Defendant B Co., Ltd. (hereinafter “Defendant B”) was implementing a new construction of multi-family housing with land D, E, and F as a business site, Defendant B’s ownership registration was completed in the name of Defendant B on February 28, 201 with respect to each real estate listed in the separate list (hereinafter “instant Claim 1”) on the real estate on February 28, 201 without obtaining approval for use under the Building Act due to the commission of the registration of provisional attachment entry by G, the creditor against Defendant B, and the real estate listed in paragraph 2 “instant Claim 2 and paragraph 3”. (b) The Plaintiff sold the instant real estate on November 1, 2013 with respect to the instant Claim 2, and on December 2, 2013 with respect to the instant real estate on December 3, 2013, and on February 25, 2014, the Plaintiff acquired the instant real estate sales price from the Plaintiff as to each of the instant real estate.
“Preparation of each sale (sale) contract, and a notary public certified by H on July 23, 2015 on each of the above sale (sale) contract. (c) Defendant B made to I on July 23, 2015 the registration of the right to claim ownership transfer as the receipt of No. 10158 on July 23, 2015 with respect to the second real estate of this case by the Changwon District Court, Changwon District Court, the registration of the right to claim ownership transfer was completed on July 23, 2015, and on October 22, 2015, Defendant C Co. (hereinafter “Defendant C”).
(2) On October 22, 2015, Defendant B made a supplementary registration prior to the right to claim a transfer of ownership on October 22, 2015 with respect to the registration of the said right to claim a transfer of ownership on the ground of sale and purchase to Defendant C. (2) On May 22, 2017, Defendant B made a provisional registration of the right to claim a transfer of ownership on May 22, 2017 with respect to the instant real estate Nos. 1 and 3 to Defendant C on May 22, 2017.
3. On November 2, 2017, Defendant B purchased and sold each of the instant real estate to Defendant C on November 1, 2017.
