A defendant shall be punished by imprisonment for not more than ten months.

However, the execution of the above sentence shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

On February 18, 2010, the Defendant was sentenced to a suspended sentence of two years for the crime of forging official documents at the Incheon District Court on August 28, 2010, and the said judgment became final and conclusive on February 28, 2010.

The Defendant is the operator of corporation D (hereinafter referred to as “D”) and E (hereinafter referred to as “E”) located in Nam-gu Incheon City, Nam-gu, Incheon.

1. Crimes related to the supply of “F” parts;

A. (i) On October 20, 2008, the Defendant entered into a supply contract with the Korea Railroad Corporation and the Korea Railroad Facilities and Equipment Parts, and received a request from the said Construction to submit a test report to prove that the said Parts meet the standards, the Defendant was guilty to forge and submit it.

피고인은 2008. 12. 경 위 E 사무실에서, 워드 프로세서 프로그램으로 오려 붙일 부분의 숫자를 작성하여 프린터로 출력한 다음, 컬러 프린터로 복사한 시험성적 서에 시험결과 표 시험 항목 중 인장 강도 (N/ ㎟) 의 시험결과 NO.3 의 ‘827’ 을 ‘777’ 로, NO.4 의 ‘737’ 을 ‘787’ 로, NO.6 의 ‘865 ’를 ‘778’ 로, NO.8 의 ‘388’ 을 ‘765’ 로 바꿔 각각 오려 붙이고, 같은 항목의 연신율(%) 시험결과 NO.1 의 ‘23’ 을 ‘38’ 로, NO.2 의 ‘22 ’를 ‘39’ 로, NO.3 의 ‘31 ’를 ‘36 ’으로, NO.4 의 ‘20’ 을 ‘36 ’으로, NO.6 의 ‘32 ’를 ‘37’ 로, NO.7 의 ‘28’ 을 ‘36 ’으로, NO.8 의 ‘1’ 을 ‘38’ 로, NO.9 의 ‘25 ’를 ‘37’ 로 바꿔 각각 오려 붙인 후 이를 다시 컬러 프린터로 복사하였다.

Accordingly, for the purpose of uttering, the Defendant forged a test report (No. 06-2008-01588) in the name of the head of the Incheon regional small and medium enterprise, which is an official document.
